COMPARATIVE ANALYSIS OF THE INSTITUTE OF ARBITRATION CLAUSES IN CONSTRUCTION CONTRACTS AROUND THE WORLD: PROBLEMS AND PROPOSALS

This article examines the legal nature and comparative regulation of arbitration clauses in international construction contracts. It analyses the international legal framework (the 1958 New York Convention, the UNCITRAL Model Law, the UNCITRAL Arbitration Rules, the 1961 European Convention and the 1965 ICSID Convention), the standard FIDIC forms of contract and the ICC Arbitration Rules, as well as the national legislation of the United Kingdom, the United States, France, Germany, Switzerland, Singapore and the Republic of Uzbekistan. Drawing on a substantially expanded body of leading case law - including decisions of the House of Lords, the United States Supreme Court, the Cour de Cassation, the Singapore Court of Appeal, the Judicial Committee of the Privy Council and the English Technology and Construction Court - directly concerning the separability and validity of arbitration agreements and the interface between FIDIC Dispute Boards and arbitration, the article identifies the principal problems that arise in construction arbitration and offers the author's own proposals for the improvement of national and international regulation.
